1. General provisions
   1.1.   Scope
These general terms and conditions represent a binding legal agreement between Gama Organica Ltd (hereinafter referred to as “Supplier”) and the visitors and customers (hereinafter referred as “Consumer” or “User”) of the website and online shop www.gamaorganica.com (hereinafter referred as “the website” or “the online store”). They regulate the rights, obligations and responsibilities of the Supplier and the Customers, regarding the Supplier's activities and products offered on the website.  The conditions set out in these Terms and conditions are applicable for all visitors of the website www.gamaorganica.com, regardless of whether they are registered through a user profile or not.
   1.2.   Definitions
For the purposes of the current General terms and conditions, the following definitions shall apply:
„Online store” is the website www.gamaorganica.com, which represents a virtual platform for distance sales, that are delivered after an explicit order submitted by the Consumer.
„User profile” is a part of the website, which contains user information. This information is voluntarily provided by the Consumer during his registration on the website and is stored by the Provider in its capacity of Data Controller. The user profile is accessed by entering a username or e-mail and password.
„Online order” is an order for purchasing one or more items, submitted by the Consumer to the Supplier via the online store.
„Price” – the final price per unit or for a certain quantity of product, including VAT. The price doesn’t include delivery costs.
“Distance contract” means any contract concluded between the Supplier and the Consumer, without the simultaneous physical presence of the Supplier and the Consumer, with the exclusive use of one or more means of distance communication up to and including the time at which the contract is concluded. A purchase order, made by the Consumer on the website www.gamaorganica.com and its acceptance by the Supplier represents a distance contract.
„Courier” – a legal entity who physically delivers the purchased goods to the address, specified by the Consumer.

   1.4.   Data protection
      1.4.1.   The Supplier process confidentially the personal data collected during Consumers’ visits on its website, and in accordance with the Bulgarian legislation, European data protection regulation (GDPR) and the Privacy policy of Gama Organica.
      1.4.2.   The Consumers agree that Gama Organica, in its capacity of Controller, has the right to collect and process their personal data in relation to the services offered on the website.
      1.4.3.   The personal data that the Supplier collects during orders submitting and profile registration are used only for the purpose of customer service (including orders execution and newsletter subscription) as well as for contact with the Consumer in case of issues related to the execution of orders, and for the purpose of improving the customer service.
      1.4.4.   The Supplier guarantees that the data shall not be processed in any form to third parties, except as described in the Privacy policy of Gama Organica, or used for purposes other than above described.
      1.4.5.   Upon Consumers’ decision, the user profile could be deleted, along with all data stored in the profile.

2.      Terms of use of the website www.gamaorganica.com
   2.1.   www.gamaorganica.com is a corporate site for presentation of the Supplier’s activities, as well as a website for e-commerce with products, offered by the Supplier.
   2.2.   The Users are allowed to use the information displayed on the website only for personal and noncommercial purposes. The content of the website, including text, publications, photos, and graphic images, logos and trademarks, product descriptions, etc., is subject to copyright, protected by Bulgarian law and all other applicable EU copyright and intellectual property regulations. Any changes, copies, modifications, reproductions, or transfers of the content are strictly forbidden, except in cases of allowed sharing, expressed with sharing options with other platforms.
   2.3.   It is not allowed texts and publications displayed on the website www.gamaorgainaca.com to be copied and displayed on other websites, online stores, advertising or commercial brochures and catalogues, or other communication means, without the explicit permission of the Supplier, or without indicating the source with the following text: “Source: www.gamaorganica.com” and a clickable link to the page, containing the quoted text.
   2.4.   On the website, the Supplier published the following information:
      2.4.1.   The main characteristics of the offered products and other additional information aimed to support the Consumer’s informed choice.
      2.4.2.   The prices of the products, inclusive VAT.
      2.4.3.   The available payment methods, orders execution conditions, and delivery terms.
      2.4.4.   The Consumer’s right to cancel (withdraw) an order, terms and condition for cancellation, as well as the terms for returning goods.
      2.4.5.   Any other information that is requested to be introduced to Consumers before goods purchase, in accordance with the Bulgarian and EU legislation.
   2.5.   The information displayed on the website www.gamaorganica.com, including the products’ description, is for general use only. The Supplier does not provide any warranty or guarantees that this information is relevant and suitable for any particular case or Consumer. The Consumer is solely responsible for assessing whether the information is individual relevant and suitable to him. The Supplier expressly excludes liability, to the fullest extent permitted by law, for any decisions or assessments, based on the information displayed on the website, made by the Consumer.
   2.6.   Published prices, quantities, payment, and delivery methods, as well as the website’s design and functionalities, are subject to change without notice. The Supplier has the right to delete information for a certain item or certain category at his discretion. All changes take effect from the moment they are published on the website.
   2.7.   The Users have an option to publish comments and opinions regarding the activities and products offered by the Supplier on its website www.gamaorganica.com. When posting a comment, Users are not allowed:
      2.7.1.   to pretend being another participant in the forum by copying name, avatar, or signature.
      2.7.2.   to pretend being a public figure by using his / her name or photo.
      2.7.3.   use of offensive or obscene words; words expressing racist, sexual, ethical, or religious discrimination; offensive descriptions of physical, intellectual, or moral features of other persons; spam; advertising content; pornographic content; copyright-infringing content.
   2.8.   In any case of violation of the rules stated in article 2.7., moderators have the right to warn, and subsequently – to deactivate the violator’s profile, to delete comments, or not to publish comments.
   2.9.   The Users subscribed for the newsletter have the option to unsubscribe at any time by using the link attached in any newsletter.

3.      Registration and user profile
   3.1.   The user has the options to use the website, including submitting orders either with or without registration of a user profile.
   3.2.   Registration of user profile allows the User to optimize his customer experience for next orders by storing certain data, such as delivery details, favorite products, orders history, etc. At any time, the User can review and edit the data stored during the registration, including his password.
   3.3.   Registration of user profile is free of charge and is done by filling in a registration form. Upon registration, the User provides a valid email and password, name and surname, delivery address, and phone number.
   3.4.   The User provides the registration data voluntarily and by his / her own will.
   3.5.   By filling in the registration form and clicking on the registration button and the button “I agree with the General terms and conditions”, the User declares that he is familiar with the current General terms and conditions, he agrees with the content, and undertakes to comply with them unconditionally.
   3.6.   The Supplier confirms the User’s registration by sending a confirmation mail containing activation details.

4.      Order conditions.Distance purchase contract
   4.1.   A subject of order is the product/products, for which the Consumer has expressed willingness for purchasing by submitting an order through the online store www.gamaorganica.com.
   4.2.   The main characteristics of the products are described on the presentation page of the respective product.
   4.3.   The Supplier accepts distance purchase orders only via its online shop www.gamaorganica.com . Orders are accepted 24 hours a day, including on weekends and public holidays.
   4.4.
   Orders are processed only on working days from 9:00 to 15.00 (CET). Orders submitted after 15.00 CET shall be processed on the next day. Orders submitted on weekends and official holidays in Bulgaria shall be processed on the first working day following the date of order.
   4.5.   All orders placed via the online store www.gamaorganica.com imply an obligation for the Consumer to pay.
   4.6.   An order placed via e-store www.gamaorganica.com shall be considered as a Consumer’s consent for concluding a distance selling contract, which is regulated by the Consumer Protection Act of the Republic of Bulgaria. Order details are stored in the database of the Supplier.
   4.7.   The presentation of goods in the online store does not constitute a legally binding offer but a non-binding online catalog instead. By clicking the button “Finalise order”, the Consumer submits a binding order regarding the goods in the shopping cart.
   4.8.   After submitting the order, the Consumer will receive an automatically generated email that confirms the order is received by the Supplier (confirmation of receipt). This confirmation of receipt does not yet constitute acceptance of the purchase order receipt.
   4.9.   The distance contract comes into force upon an acceptance of the purchase order (order confirmation), sent by the Supplier to the Consumer’s e-mail. This confirmation does not require a confirmation receipt by the Consumer.
   4.10.   The Consumer could make changes in the order information no later than receiving the order confirmation upon article 4.9.
   4.11.   Pursuant to the distance contract, the Supplier undertakes to organize the goods’ delivery and the transfer of ownership to the Consumer.
   4.12.   The Consumer and the Supplier agree that all statements between them, related to the conclusion and execution of the distance contract, shall be made electronically through electronic statements, within the meaning of the Electronic Document and Electronic Signature Act and the Electronic Commerce Act of Republic of Bulgaria.
   4.13.   The Supplier assumes that all electronic statements made by the Consumer are made by the persons, specified in the data provided by the User upon registration or upon order placing.
   4.14.   In case a change in an already confirmed order is necessary, and the change affects significant parameters, such as price, product, delivery time, etc., the Supplier shall contact the Consumer to notify him / her for the change and to obtain information if the Consumer accepts the new conditions.

5.   Payment methods, prices and delivery conditions
   5.1.   The Consumer has the right to choose a payment method and delivery method among the options offered by the Supplier. Before the order to be completed, the Supplier shall notify the Consumer for the chosen payment and delivery method.
   5.2.   The following payment methods are accepted on the online store www.gamaorganica.com:
      » by cash on delivery – available only for orders in Bulgaria;
      » by ePay – available only for orders in Bulgaria;
      » credit card;
      » PayPal.
   5.3.   By choosing a payment method other than cash on delivery, the Consumer agrees to pay in advance the value of the goods ordered.
   5.4.   All payments with credit cards are subject to validation checks and authorisation by the card issuer. If the card issuer refuses to authorise a payment the Supplier will not be liable for delay or non-delivery. All credit card payments are processed through a secure third-party payment processor. Gama Organica Ltd does not store any credit card details.
   5.5.   All prices shown on the website are in BGN (Bulgarian lev) or in EUR (depending on the currency option the Consumer chooses) and are inclusive of VAT.
   5.6.   The delivery charges are not included in the price of goods. They are displayed separately in the Shipping and Payment pages upon completion of the order and before sending it to the Supplier.
   5.7.   In the common case, the delivery costs are borne by the Consumer. In some cases, or under certain conditions, the Supplier may offer free delivery.
   5.8.   For orders outside Bulgaria, it is a Consumer’s responsibility to pay any import duties, that may be applicable for import within the country of delivery.
   5.9.   Orders in Bulgaria are delivered within 1 to 3 days, following the date of the order confirmation.
   5.10.   Orders outside Bulgaria are delivered within 4 to 10 days, following the date of the order confirmation.
   5.11.   The Supplier shall not be liable for any delay in the terms under articles 5.9 and 5.10 caused by the courier company.
   5.12.   In case of discrepancy between the ordered and the received goods, or any other inaccuracy due to the fault of the Supplier, the Supplier bears all costs for returning and replacement of the goods.
   5.13.   In case the Consumer refuses to accept the shipment, or in case the delivery cannot be executed due to incomplete or inaccurate delivery information, or in case of untaken shipment from the courier’s office, the Consumer owes the Supplier all delivery and return costs. The Supplier shall send to the Consumer a notification letter with the amount due. 

6.   Right of withdrawal and returns
   6.1.   The Consumer has the right to cancel its order (to withdraw from the distance contract), without giving any reason, within 14 days after the date of receipt of the items, indicated on the delivery documents.
   6.2.   To set out his decision to withdraw from the contract, the Consumer may either use the Standard withdrawal form or notify the Supplier on one of the following communication channels:

   6.3.   The Supplier shall send the Consumer a confirmation in written for the received withdrawal.
   6.4.   For hygiene reasons, the Supplier could accept the returned good / goods only if:
      » the goods are in their original packaging;
      » there is no trace of usе of the product/products and the packaging is not damaged, nor stained.
   6.5.   Goods shall be returned along with an original purchase document (a cash receipt or invoice) and a Standard withdrawal form.
   6.6.   The Consumer has the obligation to return the good/goods within 14 days from the date of his / her notification for withdrawal. Returning address:

   6.7.   The costs of returning the goods are borne by the Consumer.
   6.8.   The Supplier shall refund the amount of the returned good / goods, together with the delivery costs, within 14 days from the date of the return notification. The Supplier shall not be required to reimburse the supplementary costs if the consumer has expressly opted for a type of delivery other than the least expensive type of standard delivery offered by the trader.
   6.9.   The Supplier shall carry out the reimbursement using the same means of payment as the Consumer used for the initial transaction unless the Consumer has expressly agreed for other means of payment.
   6.10.   The Supplier may withhold the reimbursement until he has received the goods back, or until the consumer has supplied evidence of having sent back the goods, whichever is the earliest.
   6.11.   The right of withdrawal does not apply in cases where the goods are made to the consumer’s specifications or clearly personalized. 

7.   Guarantee of conformity
   7.1.   Gama Organica Ltd provides a warranty for defects and inconformity of products within their shelf life and if the storage condition requirements, indicated on the original packaging of the products, are met.
   7.2.   In case of damaged or defective goods received, the Consumer has the right of complaint. A complaint shall be submitted by filling in a Complaint form and sending it via email (info@gamaorganica.com) or to the Supplier’s business address (Bulgaria, city of Kyustendil, p.c. 2500, 26 Peter Beron str.)
   7.3.   Products are considered defective when they do not possess the typical characteristics or properties, including they are with damaged or non-functioning packaging upon delivery, they do not meet the legal requirements, or they are not delivered in the agreed quantity. Please note that sensitivity or allergic reaction to products is not considered a defect.
   7.4.   When a complaint is submitted, the Supplier shall send to the Consumer a document, containing details regarding the complaint – date and reference number of the complaint under which it is registered in the Supplier’s Complaint register, and type of the product, subject of the complaint.
   7.5.   The Consumer shall return the products, that are subject to a complaint, together with a filled-in Complaint form (in case it is not prior sent by email) and a purchase document (a cash receipt or invoice), within 14 days from the date of his claim notification. Address for returns:

   7.6.   Shipping costs related to returns of goods, subject to a complaint, are borne by the Supplier.
   7.7.   The Supplier shall notify the Consumer via email for the complaint processing, in particular - for its receipt, approval or rejection.
   7.8.   The Supplier shall take a decision regarding the complaint within 14 days of the date he receives the products back.
   7.9.   In case the complaint is approved, the Supplier shall replace the defective good with a new one. The delivery costs related to the replacement are borne by the Supplier.
   7.10.   In case the replacement is not possible (for instance, the product is not available, or in case of other circumstances, obstructing the replacement), the Supplier shall reimburse the amount paid for the defective product within 14 days of the date of complaint’s approval. The reimbursement is carried out to the bank account, specified by the Consumer in the Complaint form.

8.   Gifts and promotion vouchers
   8.1.   At his discretion, the Supplier may provide the Consumer/s with various types of promotion- or gift vouchers.
   8.2.   The terms of promotion vouchers, incl. the validity period and the products they are applicable for, are determined by the Supplier for each particular case or for each particular promotion campaign.
   8.3.   Unless otherwise stated, one voucher can only be used once, and only one voucher of the same type can be used for one purchase. Unless otherwise stated, discounts cannot be combined with other discounts.
   8.4.   In case the value of the gift voucher is greater than the amount of purchase, the surplus cannot be used for a new voucher, and it is not refundable.

9.   Disputes. Alternative dispute resolution
   9.1.   The Supplier endeavors to settle any disagreements with Consumer, arising from distance contracts, by mutual agreement. Any unresolved disputes shall be exclusively referred to the competent Courts from Gama Organica Ltd premises. The applicable law will be Bulgarian law.

10.   Final provisions
   10.1.   The current General terms and conditions may be amended unilaterally by the Supplier without notice. The changes do not affect the contractual rights and obligations of the Consumer and the Supplier, which arose with a purchase order prior to the changes. The Supplier publishes on his website the General terms and conditions in force.
   10.2.   For any issues, not settled by the current General terms and conditions, the provisions of the applicable Bulgarian legislation shall apply. Тhe General terms and conditions could be downloaded here.
